Condemns UNICAJA to return to our client the amounts paid for the purchase of a home

Good news for our client: sentence against Unicaja and in favour of an Abolex client who bought a house under construction

Last Friday, the Court of First Instance 3 in Jerez de la Frontera notified us of a ruling in favour of our client, condemning Unicaja to return the 43,000 euros it paid for the purchase of a house under construction, in 2005. This is an action under Law 57/1968.

The ruling reflects the jurisprudence of our Supreme Court, confirming the responsibility of the bank for not verifying that the amounts paid by our client were duly guaranteed, as required by Law 57/68.

The Court of First Instance ordered UNICAJA to return to our client the amounts paid on account plus interest from the date on which the payments were made, in accordance with the provisions of Article 1.2 of Law 57/1968, as well as the legal costs of the proceedings.

To date, Abolex has won 100% of the lawsuits filed under Law 57/1968, thanks to the experience in this field of its director, Martín de la Herrán.
